The Town of Billerica closes out unauthorized painting of crosswalks incident.Restitution agreement reached – charges not to be pursuedBillerica, MA August 5, 2015: Statement of Town Manager John C. Curran:The Town of Billerica has resolved the matter regarding the unauthorized painting of the crosswalks in the Town Center area by George J. Simolaris Jr., one of the members of the Board of Selectmen.
The Town’s primary interests in this matter were that the remedy is appropriate for the nature of the offense and that the town -- and the taxpayers -- be made whole and reimbursed for Mr. Simolaris’ actions.
Accordingly, the Town will not pursue criminal charges with the understanding that Mr. Simolaris has entered into a restitution agreement. The agreement provides that Mr. Simolaris acknowledges the unauthorized painting of the crosswalks was not proper or appropriate and was otherwise prohibited and that he has agreed to pay the Town of Billerica $4,200 to reimburse the Town for the costs incurred in removing the unauthorized paint. The reimbursement will be paid out over a period of 12 months at $350 per month with the first payment due on September 1, 2015.
The details of the restitution are contained in a Memorandum of Agreement (MOA) between the Town and Mr. Simolaris executed on August 4, 2015.
The Town of Billerica considers this matter to be closed.
