It is the policy of the Town of Billerica to conform and comply with all laws and regulations regarding public records.  Applicable laws and regulations include, but are not limited to MGL Chapters 7 and 66 as amended by Chapter 121 of the Acts of 2016 and 950 CMR 21 as enacted by the Office of the Secretary of the Commonwealth.

Guidelines to assist persons seeking access to Public Records in the custody of the Town of Billerica

Effective January 1, 2017, the Massachusetts Public Records Law, G.L.Chapter 66 and Chapter 4§7 (26) provides that a municipality must, within 10 business days (Monday through Friday, excluding legal holidays), respond to a request for records by providing access to or a copy of such records, or explaining any delay or denial.   

In order to assist the public with accessing public records, the following guidelines are provided.

Requests may be made Monday thru Friday during regular business hours which are 8:30am to 4:00pm.

Although not required, requests should be submitted in writing in order to ensure accurate and complete responses.

Receipt of Requests:  Written requests received during normal business hours, will be considered received on that date.  Written requests sent via email or facsimile after normal business hours shall not be considered received until the following business day.  Business days shall not include Saturdays, Sundays and legal holidays.

Fees:  In some circumstances, the Town may assess a reasonable fee for production of records.  If fees are to be assessed, a written estimate of the cost will be provided.


The Town is only required to provide records that are in existence at the time of a request and is not required to create a new record to accommodate a specific request.  The Town is not required to supplement its response to a public record request in the event that responsive records are created in the future.

School Records:  Public School records K-12 are maintained by the School Department and requests should be made to Billerica Public School Department Office.  Regional School District records 9 – 12 should be directed to the Shawsheen Regional School.
